Sorry but that is not a loophole, its ILLEGAL. For anyone to download, make a copy or use copywrited material without the permission of the copyright holder is equivalent to walking into a store and stealing a CD! What's causing havoc in the music industry, is people using the sites like you mentioned (note: your post was removed) to steal music and deny the rightful copyright holders of getting paid for their work.

The loophole is the fact the P2P sites contain more than copyrighted material. Therefore, they provide a legitimate and legal service. One can use a knife in legal ways. So the law has not shut them down. But the vast majority of material available on these serves are pirated material that is illegal to distribute and use.
