I have a family member who has been in trouble with the law for Possession of Cocaine, crack, perafinalia, driving woth out an operators license. He has been caught and puting jail twice for the same crimes. The third time the Judge gave him Six Months in Neo-Cap and Three years probation. He served 4 out of the six months and after two months out re-offended. These charges consitted of Possession of Cocain, Tampering with evidence (He tried to throw the crack out when the cop pulled up), possession of Oxicotton and Probation Violation. What are his chances of serving his time in prison? He never seems to get in trouble. He has had NUMEROUS accounts of possession in the last two years. Our system is NOT out to protect the INNOCENT but the GUILTY. He gos on Friday for what they call the Final Probation Viloation hearing. What might be done.

It depends what state and what county you live in. Lately the jails are too full to handle the influx of new people so the judges are opting for lesser or more creative sentences for people like you described. I don't like it either, by the way.

If you really want to do something, may I suggest you write a letter to the judge and hand deliver this to the judge's secretary prior to the hearing. You need to inform the judge just how you feel about this bad actor skating away with no real punishment forthcoming from the court.

Get other people to write letters to the judge as well (you could volunteer to take them to the judge's chambers prior to the hearing).

Just maybe the judge might pay attention and actually give this jerk some for real jail or prison time... say 2 years in prison to think about his crime. He has obviously not had anything sink in so far and keeps going out and doing it again and again. That's what is called recidivism. It's a fancy word for not learning the lesson and getting it right the first time.

Since this was not crime that injured anyone, and no weapons were used, it is hard to say, he may get some. But this is part of the issue, prisons are full, often people are held in county jails just waiting for a opening to be sent to prison. Federal Court law suits have restricted over crowding in prison.

Also many liberal judges see drug crimes as a crime with no victim and see it as a illness not a real crime.

Could not tell if this was a second time or a fourth time, your story sort of confused me. But if this is merely his second offence, he may get a yeear or less in county jail, but I doubt if much more.

Try telling Him to agree to go to a treatment facility and getting clean. If he is clean now lie and try to get clean again! Start doing something for the community before someone has to tell him to. Like helping out at a meth clinic. Show that he wants to help people before they end up like him it will show a lot.Ask the judge what he could do in the community. That he wants to be a better person and fears prison will set him back or get him hooked on the for good till he dies. If he is a dealer then he should be where you fear him to go!

The relative of tweety has tweety frustrated as this clown keeps getting no for real jail time and keeps on doing more and more drug related offenses with no real punishment. I don't think relative is a user but sounds more like a dealer. They were asking what can be done, i.e. in the courts, not what can they do for relative.
