    Garnishments on checking account
    Hi, I have a lien against me for a car loan that defaulted. I have recently contacted the company via writing that I will pay a certain amount per month, more if I can afford it.
    There have been garnishments on my checking account in the past (MI) -they have to get a court order every time they want to garnish my checking account.
    My question is, If I have committed to pay every month (have made two payments) is it legal for them to go and get a court order for garnishing my checking when I haven't defaulted on my promise to pay?
    I hope someone can help me as I would like to use my checking account, however, I am prepared to pay this off by getting money orders every month and not using my checking account.

    Did they agree to the payment plan, was it in writing ?
    If you merely said you would do it, and they did not give you a wrtten agreement, bsicly yes they can, if they verbally agreed, they shluld not, but often the people in collections lie to you.

    You could open a checing account at a different bank.
