    What state? Why are you asking? What do you mean by 'unchallengeable'? In love and relationships, nothing is unchallengeable.

    I think what your asking is how long before you can get a divorce ? In a lot of states its about 6 months or so depending on how long the marriage was. The next step is to file for disolution of marriage. That will be either contested or uncontested - meaning if you both can agree on the terms of the divorce or not. Most states allow a divorce so long as 1 party want it to happen and you don't have to provide a reason.

    You have to live within the terms of a written, FILED Separation Agreement in NY State and then you can file for a divorce on those grounds. Obviously different in other States.
