    Me, My son, and Taxes
    I have a 6yr old son who I have every other weekend visits with. I pay child support that is court ordered through payroll deductions, and I have no arrears. My question is; What rights do I have if any when it comes to claiming my some on my taxes? If his mom is apposed to me claiming him is this something that the courts would be able to allow me to do?

    If you are divorced this matter of who is eligible to take the child deduction is spelled out in the settlement agreement paperwork. If you were not married that's a different story.

    Yes, in all child support and custody agreements I have seen, that is spelled out in the court order. In lack of a court order, normally ( and I say normally not always) child support in and to itself is not considered enough support to allow them to claim the child. Since the housing, the food, the medical care and all other expenese would nomrally be considered the primary amount.

    You are out of luck unless you have custody of him. Whomever the child lives with gets to claim him unless you have it court ordered that you alternate every other year claiming him. Best of luck to you.
