    Filing in separate states
I work and live in Delaware. My wife lived part (approximately 50%) of the time in mayland to help her sick mother. She paid income taxes in Delaware because her employer is based in Delaware, although she worked from home which included part of the time in Maryland. Can she file as a Maryland resident? If so, how does she go about doing it?

She DOES habe a legal requirement to file in Maryland.

She can download the appropriate tax forms from the Maryland government website, or the tax pro she uses will be able to prepare the Maryland return for her.

However, she will also be able to claim a credit against her Delaware tax return for the taxes she will pay to Maryland so she should not get double-taxed.

This situation SCREAMS for professional tax help. I am available and have handled similar situations hundreds of times. Contact me at [email protected] if you are interested.

She may not qualify to be resident of Maryland. And, as a nonresident she will report income only from Maryland sources.
