I ansered no, but in1969 Iwas discharged from the USMC with a bad conduct discharge. And was denided the pemit is this legal. I have not been in any trouble since then. Should I have been issued the permit. Thank You

If you filled out the Form 4473, it was question 12.g

I understand why you answered no, as answering yes would have prevented you from receiving a firearm/permit. As it states in part

Again, that is if you filled out the Form 4473. You answered NO, when you actually had received a dishonorable discharge, so that constitutes fraud.

Your discharge was definitely grounds to deny you. While we, as merchants, are not privy as to why you were denied, NICS knows exactly why, and you have the right to appeal with NICS. When you appeal, you will be sent a letter in approximately 30 days telling you the reason for the denial. I have had many times when a client appealed, that the denial was overturned.

So, if you have not, go back to your merchant, and file the proper appeal paperwork so that you know if this is the reason as to the denial.

My family's company does these checks on a daily basis is Tennessee... handgun carry permits as well as firearm purchase transactions.

So, in answer to your question, you were legally denied, but you, yourself, did not answer the form with the truth.

No, the fact that you lied gave them reason to deny you - and I don't know if a dishonorable discharge in 1969 would have given them grounds (to deny you). Yes, it's legal and, yes, it's now on a permanent record somewhere.

I am sorry you did not get your permit, but this is one thing they look at.
