I've been served with papers that my dauhters father served me on Friday. He had it for over a month and my case is on mon. well it states he is looking for full custody because I am unfit as a mother, so he claims. He states I'm unfit cause I leave my child at a daycare center mon. - fri. from 8-6. she is left there because I am working. He is a person who works off the books and doesn't pay taxes as well. mon. will be our frist hearing what should I expect.

I am not a mother but I have worked at a daycare for 2 years so I know some of the problems that parents go through. Just because you bring your daughter to daycare because you have to work to put food over the table and a roof over you and you'r daughters heads does NOT in any way make you a bad mother. You are doing what is best for her and you, your ex and the judge know that. There has to be another incentive as to why he wants full custody of your daughter.

Doesn't sound like he has a case. He may have problems showing income.
There is always some Spineless Lawyer that has NO problem trying to separate a Mother from her baby, Hopefully a Judge will see that. Try not to let the Intimidation get you.

Hang in there Carol. If he is working off the books, he can't prove that he has adequate income to care for the child. As long as the day care is a good place, he has no case. Millions of us women, single and married use day care. My daughter loves her after school care.

Well I am a single mother but currently in a wonderful relationship. I believe this has something to do with this action. He is jealous that my daughter is around another man role model who cares for her.
Claims against me - daycare from day to night
A child needs 2 parents present. - (ok I also believe this true. But he's the type of man that needs to have things revolve around him and his time frame.) I believe a child needs come before any parents needs.
What's to give financial help - (he never gave money before now he wants to... I really can't believe this is happening.

I've never even bothered with child support cause he always has excuses for not having money... rent, car payments, food for his house, and so on... I let things be and this is how he repays me. Now that he saved and is back on his feet.

First keeping a child at day care is not being unfit, I am surprised the jduge is even hearing it.

You should have an attorney, if you don't have one now, ask the court to continue the case to give you time to get one.
