    Waive child support?
    I am living in NYS & my soon to be ex is in Florida. I already have court ordered child support that is being enforced through the Support Collection Unit, but my ex is after me to go to the court and tell them I do not want child support. (He is thousands in arrears and doesn't want them to garnish his salary.) I refuse to do that. My question - is child support mandatory in NYS? Is it possible to waive support in NYS? (He tells me it is!)

    Judge would not let you, don't worry about him, it is a great idea to garnish his pay, many courts do it from the start

    A judge MIGHT allow you to waive support if you can prove you can support they child and your ex is destitute. But if you refuse there is nothing he can do about it.

    Why should you care if its possible,if you don't want to do it?

    I'm wondering if it's possible because he has threatened to take me to court and I just want to be prepared.

    He can threaten all he wants. Take you to court for what? If he tries to terminate his rights, he will not get very far. Even in the unlikely event he gets his rights terminated, that wouldn't stop child support. If he tries to force visitation, you need to document his abuse and if you can prove it, that will quash that.
