    Statute of limitations for medical procedures!
    Hi,

    I'd like to change the topic. My father had cataract surgery in 2000 on both eyes. He had one eye done first and it went well. However, the second eye to this day, has not recovered. Dad says it's like looking through a glass of water. The doctor has maintained that his eyesight will improve over time. This is 7 years later and very little has improved.

    My question is - is it too late (Statute of Limitations) to file a law suit against this doctor that clearly screwed up? This case involves a doctor in Winnipeg who is likely retired now.

    I'd appreciate any input. Thanks a lot.

    Your dad's age may be against him and as I understand it, cataract surgery doesn't guarantee l00% recovery. Just be thankful your dad can see almost as well and forget about suing the doctor who did the surgery. You would have a tough time proving he screwed up after such a long period. Anyway, you would first have to complain to the College of Physicians and Surgeons, a long drawn out process, but they do investigate all complaints. They would have a chapter in Winnipeg.

    My fil had it done and they only gave him percentages of improvement. Luckily for him his did so well he doesn't even need glasses anymore.

    I don't know. I'd pay a visit to a couple of medical mal-practice lawyers. If THEY think he has a case, they'll take it on contingency, meaning your dad will only pay if he wins. The first visit should be free.

    If they want to charge him by the hour, that means he doesn't have a case.
