    My rights in ny on divorce
    :confused: my wife wants a divorce. I have two step childern,ones 17 ones 19 both live in the house.she tells me that her daughter 19 can stay in the house because she will be going back to college. I say no because her and I dod not get along.can I legally tell her to leave?

    As long as you are married, and both living in the house, she can allow her daughter to live there, and you can not make her leave.

    If during the divorce you get ownership of the house, and the exwife moves out, you can force the step daughter out.

    Now with that said, how long have you been married, I view step children just as I would my own child, A commitment I made when I married their mother. So if she is going to college you should as a moral issue allow her to stay.

    If our home is in my husbands name and we divorce, will he automatically get title/deed to house, or am I entitled to half?

    I live in N.Y. If we divorce and our home is in my husbands name, does he automatically get the house or do we sell and split money. Communety lproperty?

    rekellyjr: You need competent legal advice. I would walk out the door before I got into a screaming match. If the marriage is over, the divorce will resolve issues of alimony, debt, property settlement, etc. Get with a lawyer.
