    Month to Month lease
    Hi,
    I'm little confuse and need help about my lease from you guys. Here is my situation.

    1. I moved in somebody's house and rent a room. I moved in 6th January, 2007. I paid prorate rent.
    2. I signed a lease from month to month basis. Also obligated to give 3 weeks notice to tenant before leaving.

    3. I decided to move out and gave the notification on 18th Dec, 2007.

    ----------- I expected as he prorate me when I came in, it would be the same and I can move out 7th Jan,2008.--------------

    Now He is saying, I have to pay the whole month of January because lease was month to month basis.

    Do I have to pay for the whole of the January month?
    What if I move out before 1st of January? It will not be 3 weeks but at least I'm not living in that month.
    What are my choices?

    I'm living in the state of Minnesota and I don't think he pays the rent tax. I don't hope to get that rent tax form from him what we usually get to file the tax.

    Please, help me for this case.

    Well don't know anything about rent tax, there is nothing like that anywhere I have ever owned property, I pay taxes on the income from my properties.

    But normally notice is from pay period to pay period, but this is with month to month rental and normally require 4 week notice.

    But unless the lease says they will pro-rate, most likely they are correct.

    If the rental period is a month but the lease specifies a 3 week notice, then I don't see how they can say you owe the full month. I would tell them to sue you.
