Foster Mother doesn't know how to take care of infant.
Someone I know had a baby in November. The baby was with drawing. Since she came up posative, the hospital filed a 51A on the mother. Now, it has gone to court, and the judge said that if the baby needs no special equipement, then she is going to go home with her mother to her program, but the catch is that they have to get an emergency hearing before they let the baby go home. The infant is getting discharged from the hospital today, and since they haven't had their emergency hearing yet. So the baby is going to a foster home today. The catch in all of this, DSS told the mother of the infant, that they were still training the foster mother in infant care.
If anything happened to the infant daughter in the care of a foster parent, who clearly has no idea how to take care of a baby, could DSS be held responsible?
