You have all the rights as a married father... the issue is if you act on them or not. A father is a father entitle to rights to his child, regardless if you are married or not.
Are you on the birth certificate?
Until there is a court order in place there is no rights, you have to prove you are the father though the courts with a DNA test and then file in court for visits.
I know for a fact because I', in a situation of this kind that as long as he's on the birth certificate he has just as many rights as you do as a parent as you do.
Now.. if he has a violent background or has been in jail for any violent crimes you can get what they call supervised visitation where he has to go down to a government building and see his child for a certain amount of time per week. If he is shown as a good parent and no violence or criminal past I suggest you get a very good attorney! Goodluck! :)
For a baby born out of wedlock, the father has no rights until paternity is established. Now paternity can be established in a few ways. Whoever is listed on the birth certificate is legally the father unless it is challenged. In that case a paternity test needs to be performed.
