    Mal practice
    I need to know about medical malpractice, I went to the hospital Saturday afternoon, and the er doctor told me to pee in a cup and then came in and said and I quote, you have a primary doctor there is nothing I can do for you... is there anything I can do... I didn't think they could refuse treatment... he didn't check me or anything... Just insinuated that I was a drug addicted and I am not and I do have a witness... does that fall under malpractice

    Not even close. What is sounds like is your medical coverage refused ER treatment because there was no medical emergency and referred you to your primary care physican. While the insurance company MIGHT be liable if there was a real emergency the ER is not.

    Another question is what kind of hospital you went to. Was it private or a public hospital. There is a difference.

    Private hospitals can refuse treatment based on insurance or lack thereof.

    Hello lone:

    He did make a diagnosis. And, he did treat you. That's what's he's supposed to do. You just don't like the treatment he gave you.

    Course, if you had a broken leg and he refused to treat you, then you'd have a case. But, you didn't say what was wrong with you, so how could we say his treatment was malpractice??
