I'm not sure there is an easy answer to your question. Are you still legally married to your wife? Do you anticipate going through a divorce? If so, then your best bet may be to have your attorney file a motion for discovery. THis will compel her to reveal all of her assets. As her legal spouse you should be entitled to a portion. If no divorce action is filed then have your attorney sue her outright for half of the inheritance.

Probate court should have record of any wills. It might not be filed right away, and sometimes I know it can take a while before things are settled. If you are thinking about the inheritance being community property, don't count on that. You'll have to get a lawyer to find out the specifics, but depending on your state, and how the inheritance is set up, the amounts might all be exempt or not considered your joint property... I also think any amounts would have to be dealt with in your court proceedings if that stuff is not final... if you find out later that things were left out, that would not be good for her...

I don't think so - an inheritance by one party is not community property in most States. It is considered to be separate property; thus, the other party is not entitled. There is no "half of the inheritance" at play.

And, yes, a motion for discovery as part of a divorce would reveal all of her assets.

Check with your local Probate Court, see if the Will has been filed, go down and see what it says.
