    How can I change my sons last name? I just divorced his father and he will not give his consent. We live in New Jersey.

    Is he listed on the child's birth certificate as the father? Also will you be going for child support in the near future?

    You can't. If he's the father and his name is on the because I doubt if you can legally change it without his permission. Maybe you can make it part of the divorce settlement.

    However, you can use any name you want as long as there is no intent to defraud. So if you want to register your child in school and John yourname instead of John hisname, you can do that. Once he's 18, he can choose to change it legally.
