    :confused: Hi I just wanted know what type of right I have as far as my children recently me and there father split he mor finacially stble so I've decided to allow the kids to go live with him intil I complete school. I just wonder if there's anyway he can keep the kids from me when it's time for them to return? Charlesetta

    Of course there is. It is called a divorce settlement. IF you give him custody in the divorce, then you will have to go back to court in an attempt to regain custody if and when you become financially stable.

    To bad you cannot both work together for the benefit of the child. Have a long talk about it before you make a move, hopefully an honest dialogue can save heartache later. Are there alternatives such as your parents to help with babysitting? There are also agencies that will pay for child care. Consider your options first.

    What is your custody plan now? Do you have one?
    You need to go to family court and file for joint custody if you want them to live with him for now. If you just 'let him have them' - then when you want them you go to court the Judge is going to wonder why you didn't have any arrangements made in court, what your interest was in the kids and your history of visits and involvement, why after all this time you are just now taking some action at trying to see them or get them.
    Your only real solution is go to court and file for joint custody if you feel you can't be a full time mother to them now. If you don't at least get them for weekends and/or whatever the plan you agree on at court they will say you are neglectful and do not deserve them.
    At least it will look better on your part and you might have a better chance at increased time with them later.

    Who has the kids will be decided by the courts. When you split, if you are married you file for divorce, and with that a child custody agreement and child support agreements.

    If not married, you still file in court for custody issues. Since he will have the children for some tme, it should be easy for him to get full custody, and you could have visits with them.
