I own my home but he has lived with me since I bought it 2 yrs ago. He will not go willingly and we have a child together. Do I have to serve him and eviction notice?

I would say yes - if he won't go willingly you have no other way to get him out.

If he has established residency, then you have to evict him. SoI've moved this to Real Estate Law.

Check with your local court for the process.
