    How can I negotiate lower Chapter 13 payments?
    Hi,

    I am on my third and final year in a chapter 13 repayment bankruptcy. I was told when I started this that only those creditors who responded to the notice that chapter 13 was filed had to be repaid. Not all the creditors responded, yet they are making me make payments on the total amount originally filed. This payment is really high and is becoming a hardship, causing me to fall behind on other bills.

    I live in Philadelphia, PA and was wondering if anyone knew how I might get them to lower the payments. My lawyer doesn't seem to answer my questions, nor does she seem to look out for my interests. Can anyone help?

    I do not believe you can change a Bankruptcy Order - if you overpay the Court the money should be refunded to you. Go to Court and review your file, talk to the Clerk - they have to keep you informed about the payments you make and what they pay out.
