    Bankruptcy and mobile home eviction
    I live in Michigan and need to know what the law is for once a Bankruptcy Chapter 7 has been filed how long does the debtor have to move once the mortgage company he is buying his mobile home from has lifted the bankruptcy stay? Also, is there any law or legal way to extend the eviction period? Thank you :) :)

    A person is required to move as soon as the property changes hands. The person can refuse to vacate forcing the owner to go through the eviction process which generally takes about a month.

    Scott, Thank you, but in this situation, the property has not changed hands as the people have just filed for bankruptcy a couple of weeks ago. The owner is going to evict them, because they are filing bankruptcy and has given them until Dec 28th to move. I was just wondering if you or anyone knew of a Michigan law that could stop the eviction process or maybe just postpone it for about 2 weeks to give them a better chance at finding a new place to move. Txs Jane

    Nothing I know of can forestall the evitiction process, but that process can take a while. The first step in that process is an order to vacate, after that period passes, the owner has to go to a court for the eviction which means a hearing. Once the eviction is ordered there is still time before the sheriff comes to escort them out.
