A conditional discharge is NOT a conviction. Provided he complies with the conditions imposed on him, than it will NOT show up on any criminal record check.

Wrong, try again. If you look on RCMP website you will find that conditional discharges still show up on any criminal record, but are automatically purged after 3 years from the date of sentencing. Although it is not a conviction it comes up as not clear, or the individual may or may not have a record.

You do not have a criminal conviction if you comply with a conditional discharge and so the statement may or may not have a record does not actually make any sense.
Secondly, there is no phrase such as "not clear" when referring to a record of activity. In some cases (mainly travel) aconditional discharge may be indicated, however, for most purposes and most checks it will not appear.
I am a little confused, however I do understand that a conditional discharge does not show up on a criminal record as it is not a conviction however it is also true that conditional discharges are removed after three years so will it show up on a criminal record check during those three years?
