    Looking for answers on eviction process after a foreclosure in state of va
    I just had my house foreclosed. Sadly, no one bought it at auction. Quite a beautiful home. We have not heard from the bank about what will happen for us to have to move out. I know we need to move but are currently looking for something affordable. We talked with the attorney/trustee that handled the auction to see when we needed to be out by. He stated that the bank would send us a letter in 14-28 days. My mother-in-law says different. She said they could put a padlock on our door and we wouldn't be able to get to any of our stuff. But she lives in Ohio. Wanted to see if anyone knew what the process for eviction after a foreclosure was for the state of va.

    I hope this helps:

    The eviction process varies from state to state but, pretty much, the eviction process works like this:

    1. When a home is foreclosed, the new owners can send a legal notice to the previous owners to leave the home through a notice that is good for a set amount of hours.

    2. If the previous foreclosed on owners don't leave within that set period, the new owner can go to court and present his case to the judge.

    3. At the hearing, the judge will decide if the previous owners should be evicted or not as well as how long they can stay before they have to leave. If they are willing to pay rent, they can prolong their stay.

    4. If the judge decides the previous owners have to leave and they are not happy with his decision, they will be given a specific period to appeal.

    5. If the previous owners have been ordered to get out and they don't move out on their own by the date specified in the order, the new owner can have the sheriff come and physically remove them and their items from the premises.

    6. A sheriff will give the previous owners notice that they will be there in less than a certain number of hours and that the previous owners have that much time to get out on their own.

    7. Anything left in the house is moved by the sheriff into storage. The previous owners will have to pay fees to get it out of storage.

    8. If the previous owners go back to the premises, they can be arrested for trespassing.

    Yes, if it is foreclosed, you are to move out at once normally, in our state they will give you a 3 day notice to move prior pad locking the door.
