Do you mean he has had legal custody of your daughter since 2005, you got back together and now you've split up again and you want custody?

You'd have to go back to Court - no easy way.

How did he get custody in 2005?

You'll have to go to court and file a motion. An attorney can help you with this. Of course there's no guarantee that you'll get it, even with an attorney.
