    Being Evictied
    I am 3 months behind in my rent. Last week I filed Chapter 13 to keep from being evicted. I got a letter today saying the judge denied my order for a 30day extension. Motion was denied. Does that mean I can be evicted on Monday or something? What recourse can I take?

    Desperate and terrified!

    First I doubt a chapter 13 will stop an eviction, which is basically what happened when the judge did not allow it.
    And if you had enough money to hire an attorney to file a chapter 13, enough money to pay the several hundred dollars needed for court fees, why did you just not pay your rent.

    But if you don't pay your rent you should just move out, since it is not fair at all to the landlord who expects to be paid. This is like stealing money from him.

    I only paid $200 for the laywer. I paid $274 for the filing fee. I cannot afford a lawyer. I am not trying to steal from my landlord. I am trying to stay off the streets of NY. I have every intention of paying my landlord. I just need a couple of months to get gather myself. It is not a permanet state. My rent is $2000 so I was just trying to buy some time. I guess it was the wrong way to do it. I can't even afford to move. I don't know what I'm going to do. I guess I'll go to court on Monday and try and get more time.

    You said you paid $200 for a Lawyer but then you said you cannot afford a Lawyer -

    Did you hire an Attorney but you haven't paid him in full and so he/she won't help you?

    And, no, Bankruptcy will not ward off eviction.
