    Upset MOm
    :( My kid's father has not paid child support or did anything for our children in nearly two years. I have paid for child care, medical insurance, dental insurance, school, chlothes, and any else they have needed. What rights does he have? He had gotten into a new relationship and is trying to make his girlfriend think he is a good parent so to prove it to her he has been aggravating me by saying he can take the kids from me. Any advice?

    Well he can certainly try to get custody of the kids. But if he hasn't seen or paid anything towards their support in over 2 years, then all I can say to him is "lotsa luck" 'cause it ain't going to happen!

    He has all the rights he was given at the child custody agreement, visits, and so on. If he is not doing his part of the agreement, that does not take away any of his rights, it merely gives you the right to take him back to court and back to court to inforce your rights.

    I have been back to court several times. He never paid anything and he got a slap on the wrist. Now because of that he thinks nothing can happen to him. Caifornia court is different from that of my hometown. Obviously a man taking care of responsibility isn't an issue.

    Well trying is what I'm afraid of him doing. A single parent in San Diego with 3 kids. On disability because of an illness, well an attorney isn't quite in my budget. He has his girlfriend who works as an escort, so she is willing to pay for one for him. I love my kids and since birth he has been running. All of a sudden because he wants to seem like some perfect man to this girl, he is trying to make me miserable.

    For a change in custody he would have to prove you unfit, since the court awarded you custody in the first place.

    Doesn't sound like that is likely. But you really should consult an attorney. If he has court ordered support that he is not paying, you should be able to enforce it. Garnish his salary for example.
