    30 day notice
    My tenant refuses to admit she signed a month to month tenancy, rather that she signed a 12 month lease. I have copies of the tenancy. She is pulling all kinds of legalities and is threatening to sue me. My home is only 2 yrs old she has 200 pic of tedious repairs i.e.. Nailholes etc. we have tried to work things out i.e. removing some trash in yard fixing some of the items that we thought needed fixing. She has called me a slumlord. Quoting all kinds of legal cases. Oct rent was just paid by a 3 day notice to quit. No Nov is due since 6th. I have never dealt with this kind of situation before. Please advise. Linda

    Welcome to being a landlord, yep, this is common, esp with low life scum who have learned how to live 2 to 4 months without paying before they get evicted before they move on.

    Of course trash in yard that was there prior to her moving in, or your fault should have been removed without asking and there is a mim standard that a home has to be keep up to. But again they knew the condition of the home when they moved in. So you give them a 30 day notice to move, they will refuse, and you then file for eviction in housing court.
    You should have those places on speed dial if you are a landlord, you will be going there all the time if you rent enough

    Unless the written lease has a expiration date then it was a month to month. This means you can terminate it with one month's notice. Serve her notice. And be prepared to go through eviction proceedings. You need to research the rules in your area on evictions.
