I currently live in Florida, but I want to move to Chicago and make a better lifestyle for my 2 year old son. What do I have to do to make this move and it be legal?

Get the fathers OK in WRITING, then file papers with the court notifying them of your move, include the fathers written consent. It might be best if a Notary signed it with the father.
Do you think this will take long? I want to move right after Christmas.

What if there is nothing in the courts as of right now? He has never paid child support and we haven't done anything in the courts as far as that goes.
Oh, well you are free to move where you want. Just send him a letter telling him your moving and your new address if you keep in touch.
He can take you to court stop you from moving.
Unless there is a court ordered custody and/or visitation in place, then you are not bound to stay.
