    Can you change your mine about a lease if you never moved in
    My husband and I was going to rent a townhome but the landlord stated she would make repairs and clean unit before our moving date. Upon the move in date such repairs weren't done. Unit was filfthy and in the exact condition as if the last tenant had just moved. Landlord then refused to clean the unit. The townhome has several problems, leaking roof, previous fire & water damage, and a freon leak. My family never moved in and we asked for our security deposit back. Are we able to legally retrieve it or are we stuck with the lease and the conditions of the unit?

    Well you didn't say you signed a lease, but I'll bet you did. You should have took pictures, and written the repairs that needed to be done into the lease. I'll bet you did neither.

    I don't know if you can get your deposit back. You didn't DO the things that would assure it. I would sue the crooked landlord anyway, though, and tell the judge what you told us. You MIGHT win. I'll give it 45/55 if the landlords favor.

    Most likely the land lord is not going to just "give it back" so are you ready in court to give evidence to prove your case? The landlord is in breach of the agreement as long as it was in writing that they would do these things.
