    I want more time with my child but mom is a pain
    I am paying Child support on my little girl, and her mother will not let me see her, except on her terms, I live in Tennessee and she lives in Kentucky we aren't but about 30 minutes from each other, but she still will not allow me to brign my daughter to my house, I have to spend my time out with my daughter not really getting any one on one time with her. What is the best way to go about getting visitation set up, when I can't afford a lawyer.

    Back story
    Her mother and I were not married,but we were living together, needless to say after a tense breakup and her lying to me about everything, (cheating, etc... ), we tried to get back together, but she was still seeing someone else, Now I am not even sure my daughter is mine... she doesn't favor me and my own mother wasnts me to have a DNA test done. What should I do

    By the same token, you’re not going to get anywhere in court without a lawyer. You just aren’t.

    Some lawyers will accept payment plans. Go talk to to one. They may let you make payments until you get 1/2 paid and then they'll file everything in court and let you continue paying out the rest. I know a few lawyers who do that.

    Is the child support court ordered? Did you sign the child's birth certificate?

    Bottomline you need to file for a visitation order if there isn't one already set.

    If there is one set, and the mother is not following it, then you need to file contempt of court on her and petition to have the visitation agreement revised.

    You are going to have to figure out some way to come up with the money for a lawyer... you may qualify for legal aide from your state at no charge... but you will have to go down to the court house and fill out the paperwork and see if you qualify.

    Ok, when you had the hearings on the child support didn't you ask for visitation? The only way you are going to force the mom to let you see the child is by having the court order visitation rights. And to go into such a hearing without a lawyer is asking for toruble.

    Until you get an attorney take her to court, get court agreed child suport, and specific visitation, you are at her mercy.

    Well that was your fault. You could have filed for visitation and it would have been heard at the same time child support was.

    You have acknowledged this child is yours by not requesting a DNA test back then.

    You could possibly ask for one now, but you will incur the cost of the DNA test.
    **and just for the record, just because a child doesn't "favor" you doesn't mean they aren't yours... my daughter "favors" my husband sometimes over me, and he isn't even her biological father**

    So you need to decide what you want to do... request a DNA test or file for visitation. If you HONESTLY don't think the child is yours, I would do the DNA test first then pending the results, file for visitation.

    If you didn't ask for visitation, then you made a mistake. The only way to force it now is to go back to court.
