I'm having an issue with getting my car back from my mom. She is a cosigner on the vehicle and has been paying the payments on the vehicle for I'd say the last 3 to 4 months because I was in rehab and have had trouble with employment. However, I am now employed and am willing to take over the payments, but she is putting her own conditions upon me in order to get the car back (basically if I don't do what she wants then I cannot have it back). MY QUESTION IS... do I have the right as a cosigner to just take the vehicle? I need the car to get to work and she won't give it back to me unless I show her that I've been going to meetings twice a week for the next thirty days... which is all fine and dandy... I don't mind going to meetings... but I cannot wait thirty days to get the car back. PLEASE HELP

So the car is actually in your name, right ? Even so, if she is paying for the vehicle you will have to abide by her terms until you start paying for the vehicle. Just prove to her that you can do what she wants.

Your mom is doing you a favor. By imposing hard rules to force you to get your act together. The only drawback I see is whether you will lose your job without the car. If that's the case, then explain that to her. Otherwise, meet her terms.

That being said, this is a gray area from a legal standpoint. On the one hand if you are alone on the title, she may not have a legal right to do this (though she has a moral one). However, since she has had to make payments since you defaulted, that may override the title issue. Bottomline, you would have to take her to court to decide the legal issues.
