    Can my ex get his parental rights back after he's already given them up?
    My ex has decided to give up his paternal rights to our 2 yr old son, and wants to get it done as soon as possible, my fiancé wants to adopt him when we get married but since he's in the Navy on deployment it may be a while before this happens, I want to know if, once my ex does sign over his rights, is there any way he can try to get them back? And if there is, is there any way to try to prevent that from happening?

    Hello Crazy:

    There is NO way to predict what a court MAY do in the future based upon unforseen circumstances. Since there's no way to predict what a court would do, there's no way for you stop it.

    While excon is correct, the likelihood is he won't be able to get them back. However, you may have trouble getting the courts to approve the relinquishment until you are married and your husband is ready to adopt.

    I agree with Scott... it is very unlikely that the bio father will even be able to reliquish his rights right now, since you aren't married and the child isn't being adopted right now. The courts will most likely have you wait until you are married and your husband is ready to adopt before they allow this to happen.
