    SOL in Surrey, BC Canada (Hypothetical Situation)
    Lets say I was pulled over in Surrey, BC over the past summer of 2007. I was aked for Identification which I did not have. I satisfied the constable of my identity and he issued me a couple minor motor vehicle act violations (fines). Lets say that after a couple months of investigating on suspicious grounds that they think they have found my true identity.
    Lets say that they have issued a warrant for my arrest, but have not arrested me yet!

    Do the following charges fall under the Canadian Statute of limitations of 6 months?

    1.) Driving while prohibited (disqualified) - Is this charge summary, indictable or hybrid?

    2.) Obstruction of a peace officer - is this charge summary, indictable or hybrid?

    In other words if they don't formally charge me within 6 months of the date of infraction, will these charges be tossed out?

    Please respond if you are knowledgeable enough, the crown has the option if hybrid to proceed either way.

    Only summary charges have a 6 month SOL.

    Indictable offences have no SOL.


    I do not know what those charges will be. They won't be indictable, but they might be hybrid (or summary).
