    "Normal" wear and tear
    I was told that in Washington state, a landlord must replace the carpeting every 5 years. I know that he bought this property 5 years ago. The carpet was stained and smelly when I moved in. We did not write anything about its condition on our contract. I suspect that he will charge us for replacement of the carpet. What are my rights and responsibilities?

    You were told wrong. You are responsible for paying for damage that exeeds normal wear and tear. Of course, since nobody noted the status of the carpet when you moved in, it's going to be very hard to determine what exactly IS normal wear and tear.

    If you're moving out, wait for to see what he's going to do, and get back with me.

    One thing that isn't going to help you - certainly not in court, is your statement that the carpet was smelly when you moved in. Most renters wouldn't put up with it. Apparently, you did. It's going to cause a question, however.
