My boyfriend just got out of prison and hasn't been there since the birth of our son. He wants to sign over full custody of our son because he wants me and him to work out visitations on our own and knows that he is not capable right now of taking care of a child in his living situation. How would he go about doing that.

This is something that is done through the family court system. But why would you get the courts involved you have physical custody of the child and you make it sound like he does have a problem with it. One would normally get the family court system involved when the two parents can't come to an agreement.

You both need legal adivce. If you're agreeable, you can share a lawyer. But, if you do it wrong, it's going to cost somebody bigtime in the future. You don't want that somebody to be your son.
