    Father visitation rights
    I use ti live in Va so is my daughter, my ex moved to Texas with my daughter. I live now in Florida. The mother refuse to let me see my daughter just because she has custody . How can I get visitation with my daughter... I miss her so much:confused:

    Does the mother have 100% full LEGAL custody?

    Is there a custody and visitation order in place? If yes and she is not going by them and allowing you the visitation you need to go back to court and tell the judge this. If there is no visitation order in place, you need to go to court and file for visitation.

    If there is a court order in place, you need to read it closely. It is possible that she broke the terms of it by moving out of state.

    This all depends on weather or not you already have a court order for visitation. If so, as stated above, the mother could be in contempt of court by moving out of state with the child without your permission. You can file against her and at that time address the issue of visitation.

    If you do not have a court order for visitation yet... that is what you have to get.

    You need to hire a lawyer and go to court. If you had done that in the beginning, your ex wouldn't have been able to move away from you. And you could BE part of your daughter's life right now.

    You say you miss your daughter... Do you miss her enough to pay through the nose to be part of her life?? Only YOU know the answer.
