Yes, you would need a judgement before you could file a lien. If you have evidence that he actually stole the equipment in question then you can sue him for the value of the equipment and get your judgement.
Quite simply, yes.
Without legal backing, you have no right to place said lien on anything.
Have you filed a criminal complaint with the police? Is the contractor being charged with any offense?
