    Theft under 5000
    I am an 18 year old teen mom whose going to school and trying to make things work from Ontario Canada. I was recently caught stealing from Wal-mart, stupidest thing I have ever done. This was my first time doing anything bad its totally out of my nature. I was very desperate and stole about 10$ worth of stuff, I am on social assistance so I don't have money for a lawyer.. What kind of consequences am I looking at? I already had Children's Aid come to my house and observe me and my child to make sure I was a fit parent and they have came to the conclusion that I am a good mother and closed my file. Also is there anyway I won't get a criminal record? My boyfriend/father of my child has recently moved to the states to go to college and if this is on my record we can't go and visit.

    If Canada is anything like the USA you will have to go to some anti theft classes and pay your fine. In some cases, if it is a first time offense and you are not considered an adult you can get it expunged some time after it is taken care of. Ask the Judge if you would be eligible for that when your case is all taken care of.
    Hopefully since the Children's Aid closed your file you will not have to talk to them about anything any more.

    While Canada and the US are similar we are not the same.

    First, you do not get a record until you are convicted.

    Second, consider looking into the diversion program.

    Or, get a lawyer, have him/her talk to the Crown Prosecutor and perhaps work out some sort of conditional sentence or something.

    You might qualify for a free Legal Aid lawyer, so look into that.
