I have been living under a Management company for 2+ years, just recently resigned a LEASE to go into effect in NOv 2007. I've been notified that I've become eligible to receive Federal subsidy to assist me with my LEASE payments for my family and I. The current management company refuses to allow me to make payments using the funding from the Government in conjunction to me to continuing to make payments NOR will they let me out of the LEASE, What are my rights. New lease goes in effect 1st of Nov.

You can pay a break lease fee...

I broke a lease when I was 18, but there was someone peaking in my bedroom glass door from the outside... So I broke the lease stating that I was uncomfortable and did not feel safe living there.

I'm not saying that you should MAKE something up. But find small things to use against them if need be. But honestly, just find out how much it would cost to break the lease...

You can't break your lease, unless they are violating it. They don't appear to be according to your post. IF your lease has a "break lease" fee, do that. However, I've NEVER seen such a proposal in a lease.

I'd talk to them again about your subsidy. I can't for the life of me, understand why somebody would refuse a rent check because they didn't like who made out the check. I think you CAN get this fixed. Talk to the OWNER if his manager is too stupid to accept your money.

Also talk to the Federal agency. Maybe they will be willing to make the payments directly to you and you can then pay the mgmt company. Also, the mgmt company might be violating federal law by refusing the payments.

But I don't see any grounds for breaking the lease.

I've never understood it either. Of course there is the stereotype that you must be bad if you are receiving help. Meaning you'll most definitely tear the place up and move out in the middle of the night, never to be heard from again. Which is wrong, you have the same chance of that happening no matter how the rent is getting paid. With government agencies paying the rent, you know the rent will be there every month, usually on time, and I know HUD will repair any damages that is left behind and then require the tenant to repay them or not receive assistance.

Of course, slum lords won't take government assistance because they have to obey the laws and keep their rentals up.
