I recently allowed my boyfriend to move in to my apartment where only my name is on the lease. Needless to say he is very physical and mentally abusive. I am at my breaking point and have asked him to leave. But under Michigan law even if he is not on the lease I cannot kick him out because he has taken residency. So even though I am a victim of physical and mental abuse I have to leave my own apartment. I think this law sucks and women could end up dead because of this stupid law. So anyway I now have to move or take him to court to have him evicted, so that brings me to my question of the process of eviction and how long it takes. Thank you.

It's not the law that's the problem. It's your knowledge of the law. If you fear for your safety, you can get a restraining order which will force him to move out immediately.

If you're not concerned for your safety, then you'll be inconvenienced for a few weeks. You can find your states landlord tenant law right here at the top of the forum on a "sticky" note. It's not hard to understand or follow.

Of course, the law had nothing to do with your moving in with your boyfriend NOT knowing him at all.

It's better to be inconvenienced than dead - move for a restraining order (the filing alone might get him out of there) but be concerned that he will be very, very angry or just simply pack up and move and leave him there. Better to be out the money than going through whatever you're going through.

Have you been honest with your landlord? Your landlord might be very supportive and allow you to break the lease - or perhaps the lease doesn't allow you to bring in other roommates (which your boyfriend is). Then the landlord can ask him to move.

(It's moments like this I'm glad I'm married!)

excon is right, you should be calling the cops to moment he touches you. Cops love to help ladies get restraining orders.

So its against the law to change the locks and kick him out, who cares, do it anyway if you are being physcially abused, and worry about what he may or may not do in court latter, all he can do at worst is sue you for lost rent and illegal evictions, so what, be safe first

I agree - I think you have to protect yourself. My concern is if you change the locks and he can't get in the Police will allow him to get back in if that is his residence. You might then have an even worse situation on your hands!

Concerned about another answer about Cops loving to help ladies get protective orders - "Cops" have nothing to do with protective orders; it's up to the Court system. Yes, the Police enforce them but I trust they enforce equally whether it's a male or a female with the order.
