Can I sue after having tubes tied and becoming pregnant[/QUOTE]
Hello p:
You sure might. Go see a medical malpractice lawyer. He won't charge for a consultation. He won't even charge if he takes your case. You'll only have to pay him if he wins. That's not a bad deal.

My OB told me that there was still a risk of pregnancy after a tubal ligation. Did you sign paperwork at the hospital or doctor's office? You may have signed a form saying that you understand the risk.
I told him if I got pregnant, I was naming him as the father.
Normally unless the tubes are cut there is still some chance, and in every case I know of the patient is told, most don't listen, but they are told.
I would say most likely you signed something saying there was still a chance, check all of that first.
But of course anyone can always sue anyone else.
You did sign the paper explaining that, while small, the risk is there that pregnancy still may occur.
The paper you signed is called Informed Consent and the procedure would not have taken place had you not signed that Consent.
**EDIT** That Informed Consent explains all of the risks as well as benefits, and yes, pregnancy is included in there.
If you want to sue, you can try to, but chances are it will just be a waste of time and money.
