I am the executer of my mothers estate and I will be going through the eviction process in a few months. I was wondering if the notice is delivered by a police officer or the sheriff, the tenants I have in the house will not leave with out some assistance. Also I was wondering how much of a cost this will be if anyone's knows that would be helpful.

First you have to give proper notice to the Tenants with a paper something that say why you are evicting them etc. You can first some example online if you Google it. If the Tenants still have move or leave your going to have to go to court and the eviction process or paper is about 200 bucks. There will be a hearing to see why you want to evict them and when you win that's when the court will give a paper or something so when you call the cops they can evict them because cops can't do that unless they have a court order. I'm not an expert but Im going to the same process since the Tenants want to evict me from my own house. The point of having a notice type out is because when you go to court they are going to ask have you try giving them a proper notice.

The process works generally like this:

You send the tenants a certified letter advising them that you are terminating the lease and why and giving them a date by which they have to vacate.

If they are not out by that data you go to the appropriate court for your area and file for eviction. A hearing is set at which the tenants can fight the eviction. Most likely you will win and the tenants will be given another vacate date usually within 3-7 days. If they are still not out, you go back to the court for an eviction order. You hire a sheriff or similar official to serve the eviction order and physically remove the tenants.

The costs will vary widely per area.
