    Job related loss of wages and legal fees
    I was on H1-B visa for 6 years which expired on July 31, 2007. I filed petition I-140 concurrently with I-485 in May 0f 2007. I also filed form I-765 and I-131. My I-765
    Petition for employment authorization is not yet approved so I am without job effective August 01, 2007.
    My first question is
    Can I claim lost wages under job related expenses on my Tax returns?
    MY other question is
    Can I claim legal fees deuctible that I paid to attorney and USCIS under the same
    Category?

    Sorry, but you CANNOT claim loss wages (income not earned or received) as a deduction.

    But you CAN claim the legal fees paid to the attorney and USCIS as empoyee business expenses under Schedule A (Itemized Deductions).
