What to do if you stole from an Employer?
Today I was caught stealing money over a course of two months in transactions I have never been in trouble before or stole from my employer before this and only ever had than a speeding ticket. The only reason I can think that I did it was for the money. I never stole anything in my life except for when I was little kid... I am only 19 years old Do you think that I am going to get a felony? Or if I get attorney it could be dropped to a misdemeanor The amount I stole was 3000 dollars. And I am willing to pay it all back in full. What should I do?
    Thanks

You haven't paid them back yet? If not, make arrangements now to pay now in full if at all possible. If necessary, work 20 hours a day until it's paid promptly. If you make arrangements, honor those arrangements to the tee. Ask your former employer if they plan to see criminal charges and if they tell you they are, seek the services of an attorney not legal help from well meaning friends or relatives. When speaking with your former employer, do not admit the dishonest acts so you might want to seek the atty's advice before you speak with them.

Have you been arrested? If not, do you know if charges are going to be pressed? In either case, I agree with that you'd better be getting yourself an attorney right away, before you say something that could be used against you.

It just all happened today I have to wait for the court to send me my papers I'm terrified I've never been in trouble. I asked them if I could pay them back today but they told me to wait on it.

You just stated "I have to wait for the court to send me my papers", but is the court a criminal court or a civil court. Two possibilities face you. Criminial charges and civil charges. In other words, society feels it needs laws to regulate, control itself, therefore, criminal laws have been enacted to deter individuals from actions that are criminal, such as theft, assault and such. Then there are civil issues that arise among companies, individuals and when one suffers a loss, such as your former employer did, then your employer can seek restitution from you in the form of a civil lawsuit in hopes of obtaining a judgement against you. The judgement is the court's determination that you in fact owe the money and gives your former employer the right to begin legal processes such as attaching your wages and any other assets you may have. Can I ask whether the court you mention is a civil court such as small claims or is it a criminal court. I think I may already know the answer - it's probably a civil court not criminal since you have not yet stated you have yet been questioned or arrested by the police.

I think its going to be going to criminal court because, I think its called embezzling. But I'm not sure you seem like you know a lot about this kind of stuff. Do you think it could be dropped down to a misdemeanor if I have never been in trouble before?

Also today I was supposed to be talked to by a police officer but he never came so they realesed me since they know me. So right now I will have a warrant out and have to call my Loss Prevention back to figure out what I am supposed to to do. I also have a DR # which is my case # I guess.

I want to correct you on your stmt that I seem to know a lot about this kind of stuff. I am not an attorney and please do not let non attorneys give you advise that you might follow. Follow only the advice of your attorney, no one else and not even your parents, brothers, etc or best friends!! I do not want to scare you but it's very possible that the law in your state may say that embezzeling such and amount is a felony and that is very serious. There is nothing wrong with asking questions here but this site is not meant to be a source of personal legal advice.

Your'e welcome. Good luck, I know you can face it and will take the right steps... you took a big one here by asking some questions but please don't take my advice except to see an attorney.. it's not that you are trying to hide anything youv'e done or didn't do, it's just that only a trained atty is the best one to guide you. I suggest you not make any more comments here on this public forum or any other forum or site or with anyone other than your mother, father or legal guardian whatever the case. Only discuss this with an attorney who is required to keep your statements, etc confidential.

    Hello lil:

Don't talk to them anymore. Get a lawyer.

PS> IF you misunderstood me, DON'T talk to them anymore. Don't talk to the cops. Don't talk to loss prevention.

Embezzlement is a serious crime. This is not some impulse shoplifiting, but a planned crime carried out over time.

Since it's a first offense, you may be able to make restitution and plead it down. It will be up to the prosecutor and your employer.

So you NEED to get an attorney to protect your rights and guide you through the system. With a good attorney and full restitution, you may stay out of jail.

I stoled money from my employer $35,000 it was a federal charge of embezzlement. I received 2 months in prison, 4 months house arrest and 3 months probation.

If you can work something out with the employer, please do so a.s.a.p. I would suggest that you obtain a lawyer maybe he can do some intervention and develop an agreement with your employer.

I did the same thing about 3 years ago now. The employer caught me, they agreed to not press charges if I paid them back. That was fine, I paid them back. Little did I know that the state has full power to prosecute you no matter what the actual victim says in this case my employer. Turns out 2 year after the fact of this incident the state did prosecute me and I was served up with a felong theft in the 2nd degree, along with court fees, supervision costs the whole bit. Five years on my record 1 year probation.
The worst part like you I had never had any legal confortation or problems before this. There was no 3 strikes your out, it was wham bam thank you mam. But you reap what you sow.

In NY State the dollar amount determines whether it's a felony or misdemeanor and I would assume it's that way across the country.

Were you bonded? If so the insurance company also has a say in things.

Your Attorney can advise you but it is not a good idea to stand up in Court and say, "I don't know why I did this." Far better to say, "I needed the money," whatever the circumstance is.
