    During diversion period .
    Hi , I was charged of theft under $5000 2 months ago. Then I was referred by the court to the Elizaberth Fry office for a diversion program. I have done all the proposals of the diversion program, but my next court date is in November, that means I am still in the diversion period.

    The question is : if during this time any employer checks my background, what records will they get ? Actually one employer has checked my criminal background and got negative results - I don't know what that really is, but I got rejected. Their check-form asked me "Have you ever been convicted and not got a pardon ? " I said "No". I think it is right - I never been convicted for this charge, and after my next court appearance, this charge should be withdrawn or stayed. How come the employer finds anything bad against me ?

    Anybody knows what kind of a records will come out if checked during this diversion time ? Thanks a lot!

    Hello ft:

    There isn't any such thing as a "background check". There are GOOD background checks and there are BAD background checks. If your employer hires a GOOD company to do it, and is willing to PAY, they'll find out what color underwear you like. But, if they just go through the motions, then they'll probably miss it.
