If the marriage was not dissolved under the laws of Italy, then I suspect that your husband is a bigamist.
Your first step should be to beat him over the head (metaphorically speaking) and insist on him clearing his mess up! It's his mess, he has to resolve it.
Unless you want to bring charges against him, there is nothing you can do.
Your marriage may be legal, but your husband is a bigamist and that's grounds for jail.
I just want to know for sure by law that my marriage is legal or not, then I will go from there.Quote:

I knew my husband lived in italy for 11 years and was married there and had a son, but he always told me that she got the devorce. But he has never got any papers to show for it and his wife from italy has been calling and saying that she wants a divorce.
There is no simple answer other than your husband's matching his wits with that of a block of concrete.
There is no way that his wife could put him through a divorce and court papers, depositions and hearings, lawyers, auditors and the good Lord knows what else.
Where was he when all this was happening to him? OK, his ex wife told him he was divorced and custody of their child was granted to her. And at no time was he called into a court of law? I find that extremely hard to believe. How did his ex wife manage to track him down here in the US?
Dear lady, it is time for you to talk to a divorce attorney or even a general attorney just to find out whether your marriage is valid.
According to the laws of every state ( remember there is no national US law on marriage) but a person can be only married to one person at a time.
The US does reconise legal marriage in other nations, so if he was married in Italy, he is married here in the US. IF he did not do something to divorce then basically you are not legally married.. . BUT>> with that said, the injured party may have some rights if they were not aware, if the one party believed they were divorced and so on. There will not be one clear cut answer without talking to an attorney that is experienced in divorce and marriage laws for the state you are living in.
