    Parential Rights
    I have a 3yr old daughter and her father and I are not together and speak only regarding my daughter. He is paying me child support and is not on her birth certificate. We do not have joint custody and Ive been wanting to take my daughter out of state for vacation but he doesn't let me go and has threaten me that if I leave out of state hed call the cops for kidnapping. Is there something I can do so I can travel with my daughter without any worries or trouble?

    Were you two married and now divorced? If so, what does it state in your divorce about vacations out of state? If he objects to you taking your daughter out of state, contact the attorney who represented you in the divorce. Often times, all it takes is to petition the court for permission to leave the state for a vacation.

    Your ex is bullying you. He wants to scare you and it is working. Call his bluff. Contact your attorney.

    If you were never married and never made any legal motions regarding custody and rights, then you should consider this very seriously. To protect your rights and those of your daughter.

    You have to get the court's permission to remove the child from the vicinity of the father since he objects.

    No we've never been married and never made any legal motions. We decided to make our own schedule in which he can come and pick her up and see her that would be convinient for both of us without a problem.
