Ok, my boyfriend and I are going to be having a baby in a few months. He has two other children from a previous marriage that he never gets to see and does not have to pay child support on. He wants to see them but confrontation with there mother makes that impossible. His ex-wife is now dating another man and they just had a child together. My boyfriend wants to sign over his rights to his two children. Can he do so without them being adopted by his ex-wife's partner? We live in Tennessee.

You mention that he "wants to sign over his rights" but then you say "without them being adopted by his ex-wifes partner".. I am curious to whom he wants to "sign over his rights" to if it's not the ex wife's partner. No so sure he can just give away his rights to relieve him of his obligations as a father.

Generally a parent is not allowed to terminate their rights except when there is someone looking to adopt. What I don't understand is what the big deal is. He doesn't have to pay support, the mother doesn't let him interact with them so what do you think terminating his rights gets him?

Signing over rights simply means that he will not have any decision making authority in how they are raised, what school they go to, medical treatments, etc. It does not mean he will not be responsible for their monitary welfare.

If she were to sign up for TennCare or other state or federal funded aide, they would still be able to go after your boyfriend for payment.

No, he can not. And there's no practical reason for him to do so.

If the mother doesn't want him to reliquish his parental rights he never will be able too.

Only if the mother is in agreement, and there is someone willing to adopt the child in his place, could he sign away his parental rights.
