    What if he dies and has no rights?
    Hi my ex and I have a 1 year old son together, he wants to relinquish his rights to me, as I understand it from this site he will still have to pay child support, but what if he dies or something do I still get anything from him dying for my son? Also he is married to someone else so does this change anything? Thanks

    If he dies and he has terminated his parental rights, no, you would not get anything for your son. Now you can call your local Social Security office and ask that question, as normally, your son would be elgible to receive a benefit from his Father's SS, until the age of 18. So call and ask.

    If he were to die you'd be entitled to Social Security benefits for your son until your son turns 18, same as with any other dependent child.
