    My baby mother and I agreed that I pay her 200 per month for child support because that was all I could afford because I was left all the bills when we split up. When she found out I got married to someone she got ticked off and filed a petition for child support... I am now paying $400 a month and only have $600 left for me which does not even cover my basic necesities. She lives with her mother does not pay rent or child care works part time but makes as much as me and has another kid with some other guy who is not giving her a dime and is a dead beat dad... I gave her $200 plus bought him clothes and am always there for him... IS THERE ANYTHING THAT CAN BE SAID IN COURT ABOUT HER OTHER BABY FATHER NOT GIVING HER MONEY... SHE IS DEPENDING ON THE MONEY I GIVE HER TO TAKE CARE OF MY CHILD AND SOME OTHER MANS

    There really is nothing that can be said in court that will change the fact that you are paying 400 dollars a month in child support because the judge ordered that for the nessesities of your son. The only other option you would have is to some how prove that your child is better off being with you and your wife. If you and your wife are both currently working and due to your being a complete family by being married the judge MAY award you custody if you can show that the child could and would be better off living in your home with you.

    Also, you may be able to go to court and have the judge review your income level to have a lwer amount to pay out. Take all items needed to court such as : proof of rent amount, lease, any work related expenses things like that so that the judge may see that your not making enough to pay out 400 dollars a month.

    The thread is awfully old so I wonder if the OP is listening any longer.

    Anyway, I'd respond by saying if you are paying guideline child support you are not supporting another person's child but just your own. It doesn't matter that the money also benefits another child in the household or the mom personally.

    The fact that the mom has another kid from someone else who is a deadbeat dad actually hurts rather than helps you in some states (like California) because we recognize what is called a "hardship deduction" for moms in this situation which actually results in the mom being entitled to MORE support.

    Sorry, but that's the way it is.
